Resumen
Com a significativa mudança de entendimento em matéria
de fidelidade partidária no Brasil, não há mais dúvida de que o abandono
injustificado de legenda tem como resultado a perda do mandato eletivo.
O estudo propõe-se a analisar em que medida esta visão representa
uma transformação na tutela da coerência partidária e no respeito à
soberania popular, aproveitando o ensejo da realização das primeiras
eleições nacionais sob a égide da nova interpretação. A partir de uma
abordagem crítica do panorama vigente no período, aprofunda-se o
conceito de mandato eletivo, suas espécies imperativo, representativo e
partidário , sem olvidar da atual crise de representatividade. Também
são examinadas as funções e as disfunções dos partidos, a autonomia
conferida pela Constituição de 1988 e as normas concernentes à
fidelidade. Na sequência, investiga-se a evolução da jurisprudência.
Primeiro, à luz do entendimento tradicional do STF; após, com a ruptura
originada pela consulta nº 1.398 /TSE, ratificada no julgamento dos
mandados de segurança nºs 22.602, 22.603 e 22.604/STF. Por último,
é apreciada a Resolução nº 22.610/2007/TSE disciplina o processo
de perda de cargo eletivo e de justificação de desfiliação partidária ,
além dos casos que mais significativos julgados do TSE até março de
2010. Conclui-se que houve um significativo avanço na defesa da ética
na política ainda que insuficiente, caso isolado , impedindo-se a
sobreposição de interesses estritamente privados dos mandatários, em
fraude à vontade dos eleito Significative overruling as regards party fidelity in Brazil

results in loss of mandate. This essay examines to what extent such
view represents an improvement in the protection of party coherence
and respect for popular sovereignty, profiting from the opportunity
of first national elections under the aegis of the new interpretation.
From a critical overview of the current period, it analyses carefully
the concept of elective office and its species imperative and party
representative as well as the present crisis of representation. The
functions and dysfunctions of political parties; the autonomy granted
by the 1988 Federal Constitution and the rules concerning fidelity
are also discussed. Afterwards, the essay investigates jurisprudential
evolution, beginning from the traditional understanding of the
Supreme Federal Court (Supremo Tribunal Federal STF) up to the
overruling Consult number 1398, of the Superior Electoral Court (Tribunal Superior Eleitoral TSE), ratified at the trial of writs of
mandamus 22.602, 22.603 and 22.604, by the STF. Finally, the essay
considers Resolution 22.610/2007/TSE which regulates the process
of loss of mandate and justified party desfiliation and the most
expressive cases judged by TSE until march 2010. In conclusion,
it is argued that there has been significant improvement in defense
of ethics in politics
although still insufficient, if isolated to
prevent overlapping of narrow private interests of representatives,
disregarding the purpose of electors
