Estado fiscal dever fundamental de pagar tributos e imunidade tributária dos partidos políticos : reavaliando a mens legis constitucional

Resumen
A Constituição brasileira de 1988 materializou uma ruptura institucional formalizando a transição entre o regime autoritário iniciado em 1964 e a democracia. No campo tributário, a inovação mais notável foi a clara adoção, pelo legislador constituinte, de um modelo de Estado fiscal que tem por características mais notáveis a redução da participação estatal na seara econômica, a concentração de demandas sociais como responsabilidade do Estado e, por fim, a consolidação dos tributos como fonte principal de financiamento estatal. Os tributos como fonte de financiamento estatal servem ao financiamento dos direitos fundamentais, e seu pagamento precisa ser visto como dever legal de todos, inclusive, como decorrência lógica do princípio da solidariedade fiscal. Considerando essa realidade e passados 25 anos da Constituição, é chegado o momento de reavaliar as imunidades constitucionais, especialmente no que diz respeito aos partidos políticos, uma vez que, em um regime
democrático consolidado como o brasileiro, essa benesse acaba sendo desvirtuada. O presente artigo pretende observar essa realidade, com foco especial na análise da (im)pertinência da imunidade tributária referente aos partidos políticos. Para atingir tal intento, será realizada revisão bibliográfica. The Brazilian Constitution of 1988 materialized an institutional rupture formalizing the transition between the authoritarian regime initiated in 1964 and the democracy. On the tributary field the most remarkable innovation was the clear adoption by the constitutional legislator of a Fiscal State model which has as the most notable characteristics the reduction of state participation in the economic area, the concentration of social demands as State's responsibility and, finally, the consolidation of tributes as main source of state funding. The tributes as main source of state funding serve to the funding of fundamental rights and their payment needs to be seen as everyone's legal duty, including, as a logical consequence of the fiscal solidarity principle. Considering this reality, and after 25 years of the Constitution, the time has come to reevaluate the constitutional immunities, especially with regard to political parties, since in a consolidated democratic regime such as the Brazilian one, this benefit ends up being distorted. The current article intends to observe this reality, with special focus on the analysis of the (im)pertinence of tributary immunity regarding the political parties. To reach such intent, will be carried out a bibliographic review.
