A representação política e sua mitologia

Resumo
Procura desmitificar a representação política, evidenciando as ficções jurídicas que cercam o instituto. A intenção é enfrentar as principais categorias em torno da representação política, mostrando sua imprecisão em face de uma leitura juridicamente adequada. A equivocidade dos termos, utilizados também para além do campo jurídico, leva a uma visão errônea a respeito da relação entre representante e representado, o que provoca, por sua vez, uma insatisfação com a democracia representativa e uma apatia frente à arena democrática. O primeiro mito a ser revelado
é o da soberania popular. Não é possível compreender essa noção sem afastar o significado anterior do termo soberania e sem enfrentar a imprecisão do vocábulo "povo". O caráter abstrato de ambas as expressões deve ser levado em consideração quando da interpretação do seu sentido jurídico. Outro mito sobre o qual se constrói a ideia de representação política é a vontade comum. A partir desta noção é possível reconhecer o ideal republicano, mas exige-se um conjunto de mediações. Tange-se a categoria, tão cara ao Direito Público, de interesse público, para em seguida enfrentar a própria questão da vontade na relação de representação cunhada pelo Estado
moderno. Finalmente, como terceiro mito a ser enfrentado, traz-se à discussão a ideia mesma de representação e suas várias compreensões, Seu caráter paradoxal é evidenciado, para preparar o ponto final da reflexão: uma tentativa de uma leitura jurídica da representação política, a partir do reconhecimento do caráter mitológico de seus fundamentos. Não se pretende defender a aniquilação da democracia representativa, mas evidenciar seus limites a fim de esclarecer suas potencialidades. It seeks to demystifying the political representation, highlighting the legal fictions that surround the institute. The intention is to confront the major categories around the political representation, showing its inaccuracy in the face of a legally proper reading. The equivocality of the terms, used even beyond the legal field, leads to a mistaken view about the relationship between representative and represented, which provokes, in its turn, a dissatisfaction with representative democracy and apathy before the democratic arena. The first myth to be revealed is that of popular sovereignty.
It's not possible to understand this concept without isolating the previous meaning of the term sovereignty and without facing the vagueness of the word "people". The abstract character of both expressions must be taken into account when interpreting its legal sense. Another myth on which is built the idea of political representation is the common will. From this notion it is possible to recognize the republican ideal, but it demands a set of mediations. It touches the category of public interest, so dear to Public Law, to then face the question of the will itself in the relation of representation
coined by the modern state. Finally, as the third myth to be taken, the very idea of representation and its various understandings are brought into discussion. Its paradoxical character is evidenced to prepare the final point of reflection: an effort to a legal reading of political representation, from the recognition of the mythological character of its foundations. It is not aimed to advocate the annihilation of the representative democracy, but rather to highlight its limits in order to clarify its
potentialities.
