Resumo
Defende que as normas eleitorais precisam estabelecer critérios isonômicos de participação no processo político, refletindo os eflúvios da soberania popular, outorgando a cada cidadão a prerrogativa de participar da disputa por qualquer cargo eletivo almejado. Postula que a regulamentação das inelegibilidades não pode destoar desses princípios. Conclui que, embora o STF e o TSE entendam que as inelegibilidades não têm a taxionomia de sanção, as inelegibilidades cominadas apenas podem ser aplicadas a fatos jurídicos ocorridos após a entrada em vigor da Lei da Ficha Limpa. It argues that the electoral rules must establish criteria of equality for participation in the political process, reflecting the effluvia of popular sovereignty and giving to each citizen the right to participate in the dispute for any elective office. Postulates that the regulation of ineligibility can not distune with those principles. It concludes that though the Supreme Court and the Superior Electoral Court understand that ineligibility does not have the taxonomy of sanction, the comminated inelegibilities can only be applied to facts that occurred after the entry into force of the Complementary Law nº 135/2010 (named "Ficha Limpa").
