Abstract
Enfoca a cidadania como categoria dos direitos humanos fundamentais que garante a todo indivíduo a participação nas decisões políticas de sua nação por meio do voto, bem como de sua candidatura e do exercício de cargos eletivos na representação dos interesses do povo. Destaca-se que a Declaração Universal dos Direitos Humanos de 1948 e a Constituição Federal de 1988 reconhecem a cidadania como uma das formas de promoção da dignidade da pessoa humana, sendo assegurada,
contudo, a autodeterminação de cada Estado para definir critérios de participação do povo, na forma estabelecida pelo artigo 1º, item 1, do Pacto Internacional dos Direitos Civis e Políticos de 1966. Apresentam-se os direitos políticos positivos, que consistem: (i) no alistamento; (ii) no direito ao voto, à participação em consultas populares (plebiscito e referendo) e à apresentação de projetos de lei por meio de iniciativa popular; (iii) na elegibilidade, elucidando-se os requisitos para a plenitude do gozo do direito humano fundamental à cidadania e as situações em que não se deve incorrer segundo a Constituição e as leis brasileiras. It focuses on citizenship as a category of fundamental human rights that guarantees all individuals the participation of the political decisions of their nation
through the vote, as well as their candidacy and the exercise of elective positions in representing the interests of the people. It should be noted that the Universal Declaration of Human Rights of 1948 and the Federal Constitution of Brazil of 1988 recognize citizenship as one of the ways of promoting the value of the dignity of the human person, while ensuring the self-determination of each State to define participation criteria of the people, as established by the article 1, item 1, of the International Covenant on Civil and Political Rights of 1966. Positive political rights
are presented, consisting of (i) enlistment; (ii) voting rights, participating on popular consultations (plebiscite and referendum) and the presentation of bills through popular initiative; and (iii) eligibility, elucidating the requirements for full enjoyment of
the fundamental human right to citizenship and situations that should not be incurred under the Brazilian Constitution and laws.
