O controle jurisdicional do processo político no Brasil

Abstract
Analisa o papel do Poder Judiciário no controle do processo eleitoral e partidário como uma das esferas do controle jurisdicional da atividade política no Brasil. Dentre os sistemas de controle do processo eleitoral, o sistema judicial foi o escolhido historicamente pelo legislador brasileiro, objetivando-se substituir a excessiva discricionariedade do sistema legislativo por um controle
técnico-jurídico. Busca-se, assim, com a intervenção do poder Judiciário no processo eleitoral, garantir-se a lisura, a moralidade, a legitimidade e a sinceridade do pleito. Com o advento da Constituição Federal de 1988, o fenômeno da intervenção jurisdicional no processo eleitoral ampliou-se sobremaneira, em decorrência das especificidades do controle de constitucionalidade conferido ao poder Judiciário. Dado o alcance constitucional de princípios como o da moralidade, da proporcionalidade e da razoabilidade, bem como o reconhecimento expresso dos direitos políticos como direitos fundamentais, o poder Judiciário passou a ser chamado, no contexto social, ao controle de ética no processo eleitoral. Esse perfil de controle de constitucionalidade do processo eleitoral gerou uma hipótese política de grande magnitude, que leva à investigação sobre a tendência, observada mundialmente, da judicialização da política. Nada obstante o debate em torno do chamado ativismo judicial, o Poder Judiciário tem desempenhado relevante contribuição para a afirmação da democracia no país, destacando-se a Justiça Eleitoral como instrumento estatal apto ao controle de correção jurídica e ética do processo eleitoral e partidário. jurisdicional resta democraticamente legitimado. It analyzes the role of the Judiciary Power in the control of the electoral and partisan process, as one of the spheres of the jurisdictional control of the political activity in Brazil. Among the control systems of the electoral process, the judicial system has been historically chosen by the Brazilian legislator, looking to substitute the excessive discretion of the legislative system by a technical and juridical control. Therefore, the intervention of the Judiciary Power in the electoral process looks to guarantee the smoothness, morality, legitimacy and sincerity of the litigation. With the advent of the Federal Constitution of 1988, the phenomenon of the jurisdictional intervention in the electoral process has expanded greatly, due to the specificities of the control of the constitutionality conferred to the Judiciary Power. Given the constitutional reach of principles such as morality, proportionality and reasonableness, as well as the express recognition of the political rights as fundamental
rights, the Judiciary Power was beckoned, in the social context, to the control of ethics in the electoral process. This profile of control of the constitutionality of the electoral process generated a political hypothesis of great magnitude, which leads to he investigation of the tendency, observed worldwide, of the judicialization of politics. Regardless of any debate around the so-called judicial activism, the Judiciary Power has played important contribution to the affirmation of democracy in the country, highlighting the state Electoral Justice as an instrument able to control the juridical
and ethical correction of the electoral and partisan process. Because the limitations of such control are found in the Constitution itself, the jurisdictional system rests democratically legitimized.
