A compreensão desse "fenômeno" e de suas categorias é de suma importância para garantia dos princípios constitucionais do Estado Democrático de Direito, havendo a necessidade de averiguar, em doutrina e jurisprudência, quais medidas podem ser tomadas, a exemplo da educação digital, frente a necessidade de assegurar o acesso ao direito fundamental à liberdade de expressão e à informação não enganosa e, assim, impedir a divulgação das fake news e a mácula das eleições.The participation of the people in the elections is one of the main features of democratic legitimacy. In digital times, the dissemination of "Fake News" can compromise the electoral process.
