Desse modo, inicialmente, demonstra-se que, além da Constituição de 1988 representar um marco significativo na luta pelo reconhecimento e pela proteção dos direitos dos povos originários no país, há a construção de normas legais e a criação de instituições. Em seguida, analisa-se as diversas barreiras práticas que atrapalham o efetivo exercício na participação eleitoral e quais os mecanismos que podem ser implementados para eliminar esses obstáculos. Por fim, na terceira parte, observa-se a relevância de garantir às candidaturas indígenas direitos equivalentes aos assegurados às candidaturas femininas e negras no tocante à distribuição dos recursos do Fundo Partidário e do Fundo Especial de Financiamento de Campanha (FEFC), bem como à distribuição de tempo de rádio e de televisão. A abordagem metodológica adotada foi a diáletica, e os procedimentos incluíram pesquisas bibliográfica, jurisprudencial e documental.It aims to verify the main challenges faced by indigenous peoples that directly influence their under-representation in Brazilian politics, in order to analyze Consultation No. 0600222-07.2023.6.00.0000 recently proposed before the Superior Electoral Court (TSE). Thus, initially, it is demonstrated that, in addition to the 1988 Constitution representing a significant milestone in the struggle for the recognition and protection of the rights of indigenous peoples in the country, there is the construction of legal norms and the creation of institutions. Next, the various practical barriers that hinder effective participation in the electoral process are analyzed, and the mechanisms that can be implemented to eliminate these obstacles are examined. Finally, in the third part, the relevance of guaranteeing indigenous candidacies rights equivalent to those ensured to female and black candidacies regarding the distribution of resources from the Party Fund and the Special Campaign Financing Fund (FEFC), as well as the distribution of radio and television time, is observed.
