Apresentado o problema, avalia-se o potencial das pesquisas de opinião em influenciarem as decisões dos eleitores, segundo conhecidas hipóteses do efeito manada (bandwagon effect) e do efeito azarão (underdog effect). Ao depois, é traçado um amplo panorama acerca do regime jurídico dos institutos de pesquisa no Brasil. Finalmente, chega-se ao coração do estudo: as possibilidades de responsabilização eleitoral dos próprios institutos, enquanto prestadores de serviço cuja natureza tangencia o interesse público. A questão é avaliada à luz das diversificadas figuras abusivas previstas na legislação eleitoral. Na conclusão, propõe-se reflexão acerca da necessidade de chegar-se à melhor forma de acomodar todos os valores que gravitam em torno do tema.It begins with the finding, present in the 2022 General Elections, but always present, of the relevant divergences between opinion polls and the actual result. Once the problem is presented, the potential of opinion polls to influence voters' decisions is evaluated, according to the well-known hypotheses of the bandwagon effect and the underdog effect. Next, a broad overview of the legal regime of polls institutes in Brazil is outlined. Finally, we get to the heart of the study: the possibilities of electoral accountability of the institutes themselves, as service providers whose nature touches on the public interest. The issue is evaluated in the light of the various abusive figures provided for in the electoral legislation.
