Nesse contexto, é necessário o estudo do direito ao juiz natural, do mandato dos juízes eleitorais e da Resolução nº 20.951/2001 do TSE, que estabelece, em eleições estaduais, que o recurso interposto contra sentença do juiz auxiliar terá como relator no Pleno do Tribunal Regional Eleitoral o mesmo julgador. Por meio de pesquisa doutrinária, percebe-se a ilegalidade dessa previsão da referida resolução.It discusses the principle of the natural judge and its application in the Electoral Law. In such context, it becomes necessary to study the principle of the natural judge, the mandate of electoral judges and the TSE Resolution nº 20.951/2001, which establish, in state elections, that the resource against the electoral judge decision will have the same rapporteur in the Regional Electoral Court.
