A reeleição para um mandato subsequente no Poder Executivo municipal interpretada pelo Tribunal Superior Eleitoral : o adeus à candidatura-itinerante

Resumo
A burla diante da limitação constitucional a dois mandatos
consecutivos no poder executivo é discutida no presente estudo, à luz de
recente jurisprudência do Tribunal Superior Eleitoral firmada em dois
leading cases -- RESPE 32.507/AL e RESPE 32.539/AL --, que afastaram a
candidatura-itinerante -- prática conhecida na militância político-eleitoral
doméstica a que se lança o prefeito-profissional, itinerante ou páraquedista
-- em busca de um terceiro mandato por meio de transferência de
domicílio eleitoral para um município lindeiro. O temário desde há muito
foi considerado nebuloso na doutrina e nos tribunais, considerando que o
Texto Constitucional não veda essa prática expressamente, tampouco
esclarece se a limitação a dois mandatos está circunscrita ao mesmo local,
ensejando a candidatura de prefeito que já exercera o cargo majoritário
pela segunda vez consecutiva na circunscrição eleitoral vizinha. A análise
se afigura de extrema relevância no momento político atual, em que mais
de 5.500 prefeitos tomaram posse nos municípios brasileiros, após
sufrágio no pleito de 05 de outubro passado, sob tais circunstâncias. O
estudo objetiva traçar o panorama político doméstico quanto à reeleição
no poder Executivo municipal, bem como apresentar os argumentos que
convergiram na consolidação de novel entendimento do Tribunal Superior
Eleitoral, prestigiando a mais importante característica do sistema
republicano -- a alternância no poder. The swindling to the constitutional limitation of two consecutive
mandates in the executive power is discussed in this study, in light of recent
two leading cases of the Superior Electoral Court -- RESPE 32.507/AL and
RESPE 32.539/AL -- which departed from the practice known in the political
militancy-election as itinerant candidacy to a third mandate by transferring
residence for a council election nearby. The subjects has long been
considered a somewhat nebulous in doctrine and in court, arguing that the
constitutional text does not explicitly prohibits this practice, nor clarify
whether the limitation to two mandates is limited to one place, rise to
application of mayor who has exercised the majority charge for the second
consecutive time in the neighboring constituency. The analysis is of
extreme importance in the current political moment, in which more than
5,500 mayors took possession in Brazilian municipalities, after been
elected in the last 05th October, under such circumstances. The study aims
to chart the political landscape in Brazil for reelection in the executive and
bring about the arguments that converged in the consolidation of
understanding of the Superior Electoral Court in the domestic scene,
prestigiously the most important feature of the republican system - the
alternation in power.
