Resumo
A eleição brasileira de 2018 foi marcada pela proliferação das chamadas fake news, acionadas por algoritmos de aplicativos que proporcionam interações entre atores. Nesse contexto, o meio WhatsApp (principalmente) foi utilizado como propagador das notícias fraudulentas. O alvo determinante foi o campo político, mas, inevitavelmente, atingiu às normas da Justiça Eleitoral, colocando em dúvida os alicerces da democracia contemporânea. Nessa dissertação, documentaram-se e relataram-se as defasagens do campo jurídico e comunicacional frente aos novos ambientes e processos midiáticos, bem como os esforços adaptativos dos tribunais
eleitorais. Entretanto, a instituição eleitoral - tanto em termos gerais, como especificamente em relação às fake news - desenvolveu um sistema de respostas em interlocução com outras instituições, em conversação com atores e, em particular, em parceria com a impressa profissional e as agências de checagem de notícias. Esses movimentos estão relatados a partir de pesquisa documental sistemática. Tentou-se, em cada coleção de documentos, realizar inferências. Quanto aos fundamentos epistemológicos, procurou-se beber na fonte de conhecimento, principalmente, de pesquisadores em comunicação, tais como: Ferreira (2016; 2020), Fausto Neto (2006) e Braga (2006). Nas conclusões, buscou-se explicitar essas práticas sociais analisadas na perspectiva da
midiatização por meio de documentos. Almeja-se, inclusive, evidenciar que os dois processos analisados - normas em relação ao novo ambiente e em relação às fake news - ganham inteligibilidade produtiva nas relações sugeridas em esquemas interpretativos feitos a partir das epistemologias da midiatização. The 2018 brazilian election was marked by the proliferation of so-called fake news, triggered by mobile application algorithms that provide interactions between actors. In this context, the WhatsApp medium (mainly) was used as a propagator of fraudulent news. The decisive target was the political field, but, inevitably, it reached the norms of Electoral Justice, putting in doubt the foundations of contemporary democracy. In this dissertation, it documents and reports the gaps in the legal and
communication field in the face of new media environments and processes, as well as the adaptive efforts of the electoral courts. However, the electoral institution - both in general terms and specifically in relation to fake news - has developed a "system of responses" in dialogue with other institutions, in conversation with actors and, in particular, in partnership with the professional press and the fact check agencies. These movements are reported from systematic documentary research. In each collection of documents, we try to make inferences. As for the epistemological
foundations, it seeks to drink from the source of knowledge, mainly from researchers in communication, such as: Ferreira (2016; 2020), Fausto Neto (2006) and Braga (2006). In the conclusions, it seeks to explain these social practices analyzed from the perspective of mediatization through documents. It is also intended to show that the two processes analyzed - norms in relation to the new environment and in relation to fake news - gain productive intelligibility in the relationships suggested in interpretive schemes made from the epistemologies of mediatization.
