Candidaturas milicianas e mutação constitucional das inelegibilidades : atuação do TRE-RJ e do TSE na proteção da legitimidade eleitoral

Resumo
Investiga a mutação constitucional no direito eleitoral brasileiro, impulsionada
pela jurisprudência no enfrentamento de candidaturas ligadas a organizações criminosas,
especificamente as milícias da Baixada Fluminense (RJ). Através de uma análise documental
qualitativa de precedentes do Tribunal Regional Eleitoral do Rio de Janeiro (TRE-RJ) e do
Tribunal Superior Eleitoral (TSE), combinada com uma revisão bibliográfica especializada,
a pesquisa revela uma significativa evolução hermenêutica na interpretação dos artigos 14,
§ 9º, e 17, § 4º, da Constituição Federal. Essa alteração aponta para um novo paradigma
interpretativo destinado à proteção da integridade do processo eleitoral. A análise das decisões
judiciais demonstra uma tendência clara à ampliação dos mecanismos preventivos de controle de
candidaturas, com ênfase na preservação da normalidade e legitimidade das eleições. Apesar da
relevância dessa interpretação expansiva no combate à influência do crime organizado na política,
o estudo conclui que a via mais consistente com o sistema jurídico brasileiro seria a utilização
de mecanismos processuais já previstos na legislação eleitoral complementar, como as ações
de investigação judicial por abuso de poder econômico ou político. Estes instrumentos seriam
mais adequados aos ditames constitucionais para o enfrentamento de candidaturas vinculadas a
organizações criminosas, uma vez que a análise do registro de candidatura e a aplicação da Lei
Complementar nº 64/1990 exigem critérios objetivos e taxativos de inelegibilidade. O artigo
ressalta, por fim, a imprescindível atuação do Poder Legislativo, instância competente para
estabelecer critérios objetivos e específicos sobre a matéria.
It investigates the constitutional mutation in Brazilian electoral law, driven by jurisprudence in addressing candidacies linked to criminal organizations, specifically the militias of Baixada Fluminense (RJ). Through a qualitative document analysis of precedents from the Regional Electoral Court of Rio de Janeiro (TRE-RJ) and the Superior Electoral Court (TSE), combined with a specialized bibliographical review, the research reveals a significant hermeneutical evolution in the interpretation of articles 14, § 9º, and 17, § 4º, of the Federal Constitution. This evolution points to a new interpretative paradigm focused on protecting the integrity of the electoral process. The analysis of judicial decisions demonstrates a clear trend towards expanding preventive mechanisms for candidacy control, with an emphasis on preserving the normality and legitimacy of elections. Despite the relevance of this expansive interpretation in combating the influence of organized crime in politics, the study concludes that the most consistent path with the Brazilian legal system would be the use of procedural mechanisms already provided for in complementary electoral legislation, such as judicial investigation actions for abuse of economic or political power. These instruments would be more adequate to the constitutional dictates for confronting candidacies linked to criminal organizations, since the analysis of candidacy registration and the application of Complementary Law nº 64/1990 require objective and exhaustive criteria of ineligibility. The article highlights, finally, the indispensable role of the Legislative Branch, the competent instance to establish objective and specific criteria on the matter.
