A lei brasileira de inclusão e a capacidade eleitoral das pessoas com deficiencia mental

Abstract

Analisa a possibilidade de efetivação do direito de participação nos pleitos eleitorais pela pessoa com deficiência sob o aspecto da Lei 13.146, de 6 de julho de 2015, que reconfigurou o conceito da capacidade civil, e seu impacto no exercício dos direitos políticos da pessoa com deficiência mental. Mediante pesquisa bibliográfica orientada, pretende traçar uma adequação do arcabouço legal pertinente a esse objeto, frente à segurança jurídica dos cidadãos implicados por esse direito, bem como revela a vontade política de fato dos agentes responsáveis pelo sucesso incontinenti da inovação legal.It intends to analyze the possibility of effecting the right to participate in electoral elections by persons with disabilities under the aspect of Law 13,146, of July 6, 2015, which reconfigured the concept of civil capacity, and its impact on the exercise of political rights of persons with intellectual disabilities. Through guided bibliographical research, it intends to trace adequacy of the legal framework that is relevant to this object, in view of the legal security of the citizens involved by this right, as well as revealing the de facto political will of the agents responsible for the continuous success of legal innovation.
