Calados em nome da lei : o uso de normas penais para calar o discurso político

Abstract

Analisa o uso de normas penais para silenciar ou punir os discursos políticos. Quanto ao desenho da metodologia, a pesquisa adota o método hipotético-dedutivo, pretendendo testar as hipóteses apresentadas, utilizando-se das técnicas de pesquisa -bibliográfica. A partir desse tema, busca-se analisar as formas particulares de comunicação que constroem as narrativas, a relação dos três poderes perante a problemática das Fake News (desinformação), compreender como as propostas legislativas pretendem controlar o exercício da democracia por meio das leis penais e os impactos negativos que essas restrições impõem à democracia. Concluímos que, frente à ausência de textos normativos que fixam a responsabilização diante das notícias fraudulentas, investir em um direito punitivo penal não é o melhor caminho para lidar com as Fake News e o discurso político. Como principais resultados, foi possível aferir que a problemática não se restringe unicamente a questões legais, em especial, as de natureza penal.The aim of this study is to launch an analysis of the penal norms to silence political speeches. As for the design of the methodology, the research adopts the hypothetical-deductive method, intending to test the presented hypotheses, using bibliographic research techniques. From thie theme, we seek the particular forms of communication that build the narratives, the relationship of the three powers facing the issue of Fake News, seeks to understand how the legislative proposals intend to control democracy through criminal laws and the negative impacts that these restrictions impose on democracy. We conclude that, given the absence of normative texts that establish accountability for fraudulent news, investing in a punitive criminal right is not the best way to deal with Fake News and political discourse. As main results, it was possible to infer that the problem is not restricted to legal issues, especially those of a criminal law.
