A sobrevivência do mandato presidencial na América do Sul a partir da engenharia institucional do impeachment adotada nas constituições da região

Abstract

Analisa a relação entre a engenharia institucional do impeachment e a estabilidade do mandato presidencial na América do Sul, a partir da observação do critério de tipificação dos crimes de responsabilidade que definem as situações de cabimento desse instituto nos referidos ordenamentos constitucionais da região. A análise parte da hipótese de que uma engenharia institucional débil do impeachment na constituição, mais especificamente quanto a vagueza na definição das infrações político-administrativa ensejadoras do instituto, pode acarretar a instabilidade do mandato presidencial no respectivo sistema presidencialista adotado pelo país. A verificação empírica dar-se-á a partir dos 18 (dezoito) casos de mandatos presidenciais prematuramente interrompidos nos países da região e suas causas (impeachments, renúncias, declaração de incapacidade e destituição congressual-militar), bem como a observação da relação entre os países que os vivenciaram, as circunstâncias do encerramento prematuro do mandato presidencial e a engenharia institucional do impeachment disposta da constituição do país.It analyzes the relation between the institutional engineering of impeachment and the stability of presidential term limit in South America, growing out of the observation of the criteria of typification of the crimes or political infringement which define the situations of suitability of that institute on the constitutional arrangement of the countries of the region. The analysis starts from the hypothesis of a fragile institutional engineering of impeachment on the constitution, especially as the vagueness of the definition of the political and administrative infringements on the suitability of this institute may cause a instability of the presidential final term on the related presidential system adopted by the country. The empirical evidence will be acquired by the observation of the 18 cases of presidential falls on the region and its reasons (impeachments, resignations, declaration of incapability and military-congressional deposition), as well as the observation of the relation between the countries where they took place, the circumstances of the early presidential final term and the impeachment's institutional engineering assigned on the country constitution.
