Sistema representativo e democracia digital no Brasil : uma breve análise do panorama legal

Abstract

O avanço do populismo teve um grande impulsionamento utilizando a tecnologia como meio de propagação de ideologias que até então não estavam no centro da pauta global política, de modo que surgiram diversas nuances anômalas no processo democrático. A discussão deste trabalho demonstra os pontos negativos e positivos da tecnologia, mais especificamente da internet, nas mudanças que tais mecanismos digitais acarretaram no Estado Democrático brasileiro, notadamente no processo de sufrágio universal. Com base na análise do arcabouço legal, intenta-se expor os meios estabelecidos a fim de delimitar o escopo entre legalidade e liberdade individual, com a premissa de que as regras do jogo democrático estejam consonantes aos fundamentos constitucionais previstos na República Federativa do Brasil. Ademais, busca-se elucidar a utilização da tecnologia de informação (TI) como forma de fortalecimento do processo de formação cidadã, sobretudo em âmbito eleitoral. Como critério de pesquisa metodológica foi utilizada a abordagem qualitativa, baseando-se na pesquisa bibliográfica.The advance of populism was greatly pushed by using technology as a means of propagating ideologies that until then had not been at the center of the global political agenda, fostering several anomalous nuances in the democratic process. The discussion of this work demonstrates the negative and positive points of technology, more specifically the internet, in the changes that such digital mechanisms have brought about in the Brazilian Democratic State, notably in the process of universal suffrage. Based on the analysis of the legal framework, exposing the means established to delimit the scope between legality and individual freedom is intended, with the premise that the rules of the democratic game are in line with the constitutional foundations provided for in the Federative Republic of Brazil. Furthermore, this study seeks to elucidate the use of information technology (IT) as a way of strengthening the process of citizen formation of individuals, especially in the electoral sphere. As a methodological research criterion, a qualitative approach was used, based on bibliographical research.
