Las decisiones jurisdiccionales de carácter constitucional de los organismos electorales en iberoamérica : un difícil equilibrio

Abstract

Los organismos electorales garantizan la integridad de las elecciones en todo el mundo. Estos organismos adoptan mayoritariamente naturaleza constitucional: tan to por su inserción entre los poderes del Estado, para garantizar su autonomía dada la transcendencia de su misión que determina los resultados de las elecciones, como por el contenido de sus decisiones que afectan a derechos fundamentales, desarrollados con distinto nivel de detalle en la Constitución. Esta transcendencia constitucional, ha provocado conflictos con otros poderes constitucionales. En su labor, los organis mos electorales adoptan medidas que transforman el ordenamiento en el que desa rrollan sus actividades, amplían el sentido de la Constitución en su interpretación, observando a los estándares internacionales y buscando efectividad de los derechos políticos. A través del estudio de su lugar y sus decisiones pretendemos confirmar esa naturaleza constitucional y ver hasta qué punto sus decisiones se mueven en un senti do transformador o, por el contrario, se acercaría a un abuso constitucional.Electoral bodies guarantee the integrity of elections throughout the world. The se bodies mostly adopt a constitutional nature: both because of their insertion among the powers of the State, to guarantee their autonomy given the transcendence of their mission that impacts on the results of the elections, and because of the content of their decisions that affect fundamental rights, developed with different levels of de tail in the Constitution. This constitutional transcendence has caused conflicts with other constitutional powers. In their work, the electoral bodies adopt measures that transform the order in which they develop their activities, expand the meaning of the Constitution in its interpretation, shaping it to international standards and seeking effectiveness of political rights. Through the study of their place and their decisions we intend to confirm that constitutional nature and to see to what extent their de cisions move in a transformative direction or, on the contrary, it would be close to a constitutional abuse.
