Migração partidária : uma reflexão acerca da "dança das cadeiras" no parlamento brasileiro

Resumo
Tem por escopo a análise do fenômeno da migração partidária
no interior do legislativo brasileiro. Trata-se de um comportamento parlamentar amplamente
praticado por representantes eleitos, no atual cenário político brasileiro. Por que migram os
parlamentares? Responder a esta indagação é o objetivo central do estudo. Partindo-se da
premissa de que os partidos políticos constituem instrumentos essenciais para a concretização
do ideal democrático suscitado pela Constituição Federal de 1988, a pesquisa analisou
os efeitos da troca de legenda pelos detentores de mandato eletivo, uma vez que a própria
legislação brasileira favorece a migração partidária ao estabelecer cláusulas de desempenho
para acesso ao financiamento público e à propaganda gratuita no rádio e na televisão.
As reflexões elaboradas conduziram à conclusão de que as "janelas" da lei criadas para isentar
de penalidades os mandatários infiéis, contribuem para ampliar o distanciamento entre os
eleitores e as entidades partidárias, fomentando a ascensão da figura individual do governante,
o que prejudica gravemente a representação política e, consequentemente, a solidificação da
democracia. Foi empregado o método dedutivo da pesquisa científica, já que iniciada a discussão
a partir da análise dos partidos, resultando na delimitação do tema proposto, qual seja: o instituto
da fidelidade partidária e as consequências da troca de legendas pelos representantes eleitos.
Para tanto, o estudo foi fragmentado em três tópicos que, em síntese, tratam: 1) Dos partidos
políticos, compreendendo-os como instrumentos necessários para intermediar a relação entre
Estado e Sociedade; 2) Da (in)fidelidade partidária, seu contexto histórico, até ser reconhecida
a possibilidade de perda de mandato do governante eleito, bem como as consequências da
migração partidária que se tornou endêmica no legislativo brasileiro; e 3) Por que migram os
parlamentares brasileiros?
The scope of this research is to analyze the phenomenon of party migration within the Brazilian legislature. This is a parliamentary behavior widely practiced by elected representatives in the current Brazilian political scenario. Why do parliamentarians migrate? Answering this question is the central objective of the study. Starting from the premise that political parties constitute essential instruments for the realization of the democratic ideal raised by the Federal Constitution of 1988, the research analyzed the effects of the change of legend by the holders of elective mandate, since the Brazilian legislation itself favors the party migration by establishing performance clauses for access to public funding and free advertising on radio and television. The elaborated reflections led to the conclusion that the "windows" of the law created to exempt unfaithful representatives from penalties, contribute to widen the distance between voters and party entities, promoting the rise of the individual figure of the ruler, which seriously harms the political representation and, consequently, the solidification of democracy. The deductive method of scientific research was used, since the discussion started from the analysis of the parties, resulting in the delimitation of the proposed theme, namely: the institute of party loyalty and the consequences of the exchange of subtitles by elected representatives. Therefore, the study was divided into three topics that, in summary, deal with: 1) Political parties, understanding them as necessary instruments to mediate the relationship between State and Society; 2) From party (in)fidelity, its historical context, to the recognition of the possibility of losing the mandate of the elected official, as well as the consequences of party migration that has become endemic in the Brazilian legislature; and 3) Why do Brazilian parliamentarians migrate?
