Resumo
Analisa se as ações afirmativas previstas na legislação eleitoral
para dotar as Casas Legislativas de maior representatividade e diversidade,
sob a ótica interseccional de raça e gênero, modificaram a situação de
sub-representação das mulheres negras no Legislativo no período de 2020 a
2022. Discorre sobre as perspectivas e os desafios a serem enfrentados sobre o tema no pleito de 2024 e eleições subsequentes. Realiza pesquisa qualitativa
mediante análise de decisões da Justiça Eleitoral, relativas à questão do
abuso de poder econômico por desvio de recursos destinados à promoção de
diversidade nas candidaturas e sua intersecção com raça. Associa os dados
obtidos a pesquisa quantitativa para avaliação do percentual de mulheres
negras eleitas para os cargos legislativos da correlação entre candidaturas
negras e a destinação de recursos do Fundo Especial de Financiamento de
Campanha (FEFC) para candidaturas negras em 2020 (eleições municipais)
e em 2022 (eleições gerais). Conclui que as políticas de ações afirmativas
previstas na legislação eleitoral resultaram aumento pouco expressivo do
número de mulheres negras, cenário que possivelmente poderá ser revertido,
a partir dos mecanismos de controle que a Justiça Eleitoral passará a adotar a
partir das eleições de 2024.
It analyzes whether the affirmative actions provided for in electoral legislation to provide legislative houses with greater representation and diversity, from the intersectional perspective of race and gender, changed the situation of underrepresentation of black women in the legislature, in the period from 2020 to 2022. Discusses the perspectives and challenges to be faced on the topic in the 2024 election and subsequent elections. Conducts qualitative research through analysis of Electoral Court decisions, relating to the abuse of economic power through the diversion of resources intended to promote diversity in candidacies and its intersection with race. It associates the data obtained with quantitative research to evaluate the percentage of black women elected to legislative positions and the correlation between black candidacies and the allocation of resources from the Special Campaign Financing Fund - FEFC for black candidacies in 2020 (municipal elections) and in 2022 (general elections). It concludes that the affirmative action policies provided for in electoral legislation resulted in an insignificant increase in the number of black women, a scenario that could be reversed, based on the control mechanisms that the Electoral Court will adopt from the 2024 elections onwards.
