Candidaturas "laranjas" : aspectos históricos, processuais e jurisprudenciais

Abstract

Analisa a fraude no preenchimento das vagas destinadas a candidaturas de pessoas do sexo feminino. Para construção deste artigo, inicialmente fizemos um levantamento bibliográfico e jurisprudencial a fim de apontar os conceitos norteadores sobre o tema e de fazer uma análise da evolução doutrinária e jurisprudencial sobre referido tipo de fraude. Ao final do artigo, examinamos a solução aplicada pelo Tribunal Superior Eleitoral de anular por inteiro a participação da coligação envolvida, decretando a nulidade dos votos com a consequente cassação de todos os candidatos da coligação; ao tempo em afirmamos haver vozes dissonantes e ser necessário o debate, uma vez que se trata de medida drástica e não privilegia a vontade popular.

It aims to analyze the fraud in the filling of vacancies destined to candidacies of woman. For the construction of this article, we initially carried out a bibliographic survey in order to point out the guiding concepts on the subject. and to analyze the first law suits of the "orange applications", seeking to analyze the doctrinal and judicial evolution of this type of fraud. At the end of the article, we examine the solution applied by the Superior Electoral Court of entirely annulling the participation of the coalition involved, decreeing the nullity of the votes with the consequent impeachment of all candidates in the coalition; while we affirm there are dissonant voices and debate is necessary, because it is a drastic measure and does not privilege the popular will.
