O novo crime eleitoral : denunciação caluniosa

Abstract

Examina o novo crime trazido ao Código Eleitoral pela Lei 13.384/2019, em relação ao bem jurídico tutelado, a sujeição ativa e passiva, a possibilidade de tentativa e a exigência da finalidade eleitoral da conduta. Objetivo: apresentar a nova figura criminosa e examinar suas semelhanças e diferenças em relação ao crime do artigo 339 do Código Penal. Método: análise da redação típica e da literatura e jurisprudência existentes sobre o crime do artigo 339 do Código Penal. Resultado: demonstra que há significativas diferenças entre o artigo 339 do Código Penal e o artigo 326-A do Código Eleitoral.It exams the new crime introduced in brazilian Electoral Code by the law number 13.384/2019, similar to an old figure of the Brazilian Penal Code. Purpose: to show up de new electoral crime and investigate its range and application. Method: Textual exam of the law, the literature and the judicial precedents about the false imputation on brazilian Penal Code. Result: it identifies the differences between both crimes and the most significative innovations. It analyses what the new crime seeks to protect, who can perform the conduct described, who can be its victim, and the topic about the electoral purpose of the crime.
