Do financiamento à propaganda : os impactos das reformas nas eleições municipais de 2016

Abstract

As eleições de 2016 passaram por significativas reformas quanto ao financiamento de campanhas e propagandas eleitorais. O presente estudo destacou as principais modificações advindas da extinção do financiamento por pessoas jurídicas, em vistas da Ação Direta de Inconstitucionalidade 4650/DF, e da redução da propaganda eleitoral entre outras inovações com o advento da minirreforma eleitoral. A despeito da intenção em equalizar a disputa eleitoral e controlar a corrupção, aponta-se que as modificações realizadas possuem o condão de reforçar mazelas institucionais do próprio sistema político. Através do estudo da doutrina pátria, assim como, de alguns dos reflexos percebidos nas eleições de 2016 é possível concluir que as modificações não cumpriram o seu propósito inicial. Por outro lado, analisa-se a ingerência de uma ótica moralista para realizar o controle das eleições, através da derrogação parcial e gradual de direitos políticos. Os efeitos, apesar do curto espaço de tempo para análise, demonstram, em um primeiro momento, que a manutenção dessa lógica é capaz de gerar efeitos perversos à democracia.

The 2016 elections passed through significant reforms in the funding of election campaigns and propaganda. The present study highlighted the main changes resulting from the extinction of financing by private companies, by the ruling of the ADI 4650/ DF, and the reduction of electoral propaganda among other innovations with the advent of the "minirreforma eleitoral". In spite of the intention to equalize the electoral dispute and to control corruption, it is pointed out that the modifications made have the power to reinforce institutional hazards of the political system itself. Through the study of the doctrine, as well as some of the reflexes perceived in the 2016 elections, it is possible to conclude that the modifications did not fulfill their initial purpose. On the other hand, we analyze the interference of a moralistic view from the control of elections, through the partial and gradual derogation of political rights. The effects, despite the short time for analysis, demonstrate at first that maintaining this logic can generate perverse effects on democracy.
