Quitação eleitoral como condição do registro de candidatura

Abstract

Tem como objetivo principal discutir a questão existente sobre o conceito de quitação eleitoral apresentado pela Lei º 12.034/2010 e o impedimento da emissão do certificado de quitação, nos casos em que o candidato não assumir o dever de apresentar a prestação de contas de campanha.A intenção deste artigo é contribuir para a discussão da matéria e buscar apresentar solução condizente com a real intenção do legislador, visto que é notória a divergência jurisprudencial entre os Órgãos da Justiça Eleitoral, principalmente, as decisões do Tribunal Superior Eleitoral. Por fim, será feita uma análise sobre a tentativa de promover uma interpretação da intenção do Judiciário de legislar positivamente, ambos proibidos pelas regras de hermenêutica e pela Constituição Federal, respectivamente.

It has as its main objective to discuss the exegetical excitement over the new concept of electoral discharge presented by Law No. 12,034 / 2010 and the impediment of issuing the certificate, in cases where the candidate not assume the duty to present the accountability of the campaign. The intention of this article is to contribute to the discussion of the matter and seek to present a solution consistent with the real intention of the legislator, since the jurisprudential divergence between the Electoral Justice Bodies is notorious, notably, the decisions of the Superior Electoral Court. , as well as among the Ministers of its current composition. Finally, an analysis will be made on the attempt to promote a broad interpretation in a restrictive rule of law, with a brief appreciation of the Judiciary's intention to legislate positively, both prohibited by the rules of hermeneutics and by the Federal Constitution, respectively.
