Abstract

Estuda a irregularidade insanável que configure ato doloso de improbidade administrativa enquanto causa de inelegibilidade, propondo uma estruturação do assunto, para fornecer as bases de uma interpretação mais coerente com o Direito e menos suscetível às danosas variações jurisprudenciais. É assim que, atentando para os princípios do direito eleitoral, principalmente os da moralidade e do sufrágio universal, propõe-se uma delimitação do seu conceito. Com isto, pretende o presente trabalho, limitar a incidência desta causa inelegibilidade aos casos que realmente a justifiquem com base em fundamentação jurídica adequada, corrigindo o erro histórico do casuísmo na aplicação do tema.It studies the insurmountable irregularity that constitutes a willful act of administrative improbity as a cause of ineligibility, proposing a structuring of the subject, to provide the bases for an interpretation more coherent with the Law and less susceptible to the harmful jurisprudential variations. That is how, considering the principles of electoral law, especially those of morality and universal suffrage, a delimitation of its concept will be proposed. With this, the present work intends to limit the incidence of this ineligible cause to the cases that really justify it based on an adequate legal basis, correcting the historical error of casuistry in the application of the theme.
