Fixação do número de vereadores pelos municípios

Abstract

Examina a questão do número de vereadores nos Municípios, apresentando a evolução histórica da matéria, conforme as regras constitucionais estabelecidas. Apresenta ainda a interpretação do Supremo Tribunal Federal, estabelecendo o critério da proporcionalidade aritmética entre tamanho da população e número de vereadores, o que levou à modificação da Constituição pela Emenda Constitucional nº 58/2009, assim como discute a existência de um limite implícito mínimo de vereadores na aplicação do texto resultante da mencionada Emenda.It examines the question of the number of councilors in municipalities, presenting the historical evolution of the matter, according to the constitutional rules established. It also presents the interpretation of the Supreme Court, establishing the proportionality arithmetic between population size and number of Councilors, which led to the amendment of the Constitution by Constitutional Amendment No. 58/2009, as well as discusses the existence of an implicit limit minimum Councilors in implementing the resulting text of that Amendment.
