Pré-campanha e propaganda antecipada

Abstract

Objetiva-se demonstrar, neste trabalho, os aspectos mais relevantes sobre pré-campanha e propaganda antecipada durante o ano de eleição, demonstrando os limites legais e temporais de cada período, que, com o advento da Lei 9.504/1997, sofreram inúmeras alterações, gerando inseguranças tanto para aqueles que têm interesse em ingressar na vida política, quanto para a jurisprudência dos tribunais. Para isso, buscou-se apresentar as principais características, classificações e princípios dos institutos - pré-campanha; propaganda eleitoral e propaganda eleitoral antecipada ou extemporânea -, bem como os atos permitidos e proibidos em cada fase eleitoral. Ainda, foram trazidas as consequências dos atos praticados em afronta à legislação e às normas vigentes. Portanto, este trabalho constitui-se no estudo aprofundado dos atos permitidos e proibidos aos candidatos, desde 1º de janeiro do ano da disputa do pleito, demonstrando a relevância do tema: a partir do momento em que o eleitor tem conhecimento da norma e do funcionamento do período eleitoral, ele pode escolher de forma segura e autêntica o candidato que mais se adeque aos seus ideais; e, em relação ao indivíduo que pretende concorrer, esse não é prejudicado pelo ato ilícito de outro concorrente, sendo possível tomar as medidas cabíveis.

The objective is to demonstrate, with this work, the most relevant aspects on precampaign and early advertising during the year of the election, demonstrating the legal and time limits of each period, which, with the advent of Law 9,504/1997, has undergone numerous changes, generating insecurity both for those who have an interest in entering political life, and for the jurisprudence of the courts. To this do so, we sought to present the main characteristics, classifications, and principles of the institutes - pre-campaign; electoral advertising and early electoral or extemporaneous advertising - and the acts allowed and prohibited in each electoral phase. we also brought the consequences of the acts committed, in affront to the legislation and norms in force. Therefore, this work constitutes the in-depth study on the acts allowed and prohibited to candidates, from January 1 of the year of the dispute of the election, demonstrating the relevance of the theme: from the moment the voter is aware of the norm and the functioning of the electoral period, he can choose in a safer and more authentic way the candidate who best fits his ideals; and, regarding the individual who intends to run, he is not harmed by the unlawful act of another competitor, and taking the appropriate measures is possible.
