Entre a fidelidade partidária e o perdão ao suplente : o trânsfuga arrependido

Abstract

Analisa a construção jurisprudencial da figura do "trânsfuga arrependido" no direito eleitoral brasileiro, investigando a tensão entre a fidelidade partidária, a autonomia das agremiações e a representatividade proporcional. O estudo adota a metodologia jurídico-dogmática, complementada pela análise de política judiciária, a fim de examinar como a Justiça Eleitoral, por meio de seus precedentes, tem atuado para preencher as lacunas da legislação. A pesquisa conclui que a jurisprudência majoritária tem evoluído para reconhecer a validade do "trânsfuga arrependido", privilegiando a autonomia dos partidos, o sistema proporcional e a preservação do mandato em detrimento de uma sanção formal à desfiliação temporária. No entanto, o artigo destaca que a aplicação dessa tese enfrenta um novo desafio com a introdução das federações partidárias, visto que a discussão sobre a competência para anuir com a refiliação - se do partido individual ou da aliança - gera controvérsias interpretativas. Por fim, o trabalho propõe um modelo analítico para a aplicação da tese, a fim de conferir maior segurança jurídica ao processo, e sugere a necessidade de uma normatização mais clara para o tema, especialmente em relação ao papel das federações, de modo a evitar o uso oportunista da ação de perda de mandato.

It analyzes the jurisprudential construction of the "repentant turncoat" figure in Brazilian electoral law, investigating the tension between party fidelity, party autonomy, and proportional representation. The study adopts a legal-dogmatic methodology, complemented by an analysis of judicial policy, to examine how the Electoral Justice, through its precedents, has acted to fill legislative gaps. The research concludes that prevailing case law has evolved to recognize the validity of the "repentant turncoat," prioritizing party autonomy, the proportional system, and the preservation of the mandate over a formal sanction for temporary disaffiliation. However, the article highlights that the application of this thesis faces a new challenge with the introduction of party federations, given that the discussion regarding the competence to consent to re-affiliation - whether it belongs to the individual party or the alliance - generates interpretative controversies. Finally, the work proposes an analytical model for applying this thesis to provide greater legal certainty to the process, and suggests the need for clearer regulation on the subject, especially regarding the role of federations, to avoid the opportunistic use of the action for loss of mandate.
