Reflexão sobre a segurança jurídica no Direito Eleitoral a partir da análise da decisão do TSE no "caso Kerinho"

Abstract

Analisa a decisão do Tribunal Superior Eleitoral (TSE) nos autos do Recurso Especial Eleitoral nº 0600778-27.2018.6.20.0000, que anulou acórdão do TRE/RN, e determinou reanálise do registro de candidatura a Deputado Federal, nas eleições de 2018, do Sr. KERICLIS ALVES RIBEIRO, conhecido como KERINHO, alterando a composição da bancada federal do Rio Grande do Norte. Por meio de exame minucioso do caso concreto, da legislação, jurisprudência e pesquisa bibliográfica, objetiva-se demonstrar o desrespeito da mencionada deliberação judicial a preceitos normativos fixados expressamente, bem como a precedentes do próprio Tribunal Superior Eleitoral e, consequentemente, o prejuízo à segurança jurídica do processo eleitoral e interferência na legitimidade do resultado do respectivo pleito.

It intends to analyze the decision of the Superior Electoral Court (TSE) in the records of Special Electoral Appeal No. 0600778-27.2018.6.2.0000, which annulled the decision of the TRE/RN, and determined a reanalysis of the registration of candidacy for Federal Deputy, in the elections of 2018, by Mr. KERICLIS ALVES RIBEIRO, known as KERINHO, changing the composition of the federal bench of Rio Grande do Norte. Through a thorough examination of the specific case, legislation, jurisprudence and bibliographic research, the objective is to demonstrate the disrespect of the aforementioned judicial decision to normative precepts expressly established as well as precedents of the Superior Electoral Court itself and, consequently, the damage to legal certainty electoral process and interference in the legitimacy of the result of the respective election.
