A garantia fundamental da anterioridade eleitoral : algumas reflexões em torno da interpretação do art. 16 da Constituição

Abstract

Sugere algumas bases teóricas de possíveis técnicas de interpretação e modos de argumentação jurídica em torno do artigo 16 da Constituição. Ao longo das reflexões desenvolvidas sobre a garantia fundamental da anterioridade eleitoral, as seguintes perspectivas são trabalhadas: 1) a norma constitucional do art. 16 como regra que fornece razões peremptórias; 2) a garantia fundamental da anterioridade eleitoral como trunfo contra a maioria; 3) a interpretação e a argumentação jurídicas fundadas em direitos fundamentais; 4) o papel da jurisdição constitucional na proteção dos direitos fundamentais.

It suggests some theoretical basis for possible techniques of interpretation and forms of legal reasoning at the article 16 of the Constitution. In the course of the reflections about the fundamental guarantee of electoral anteriority, the following perspectives are worked: 1) the constitutional norm of the article 16 as a rule that provides peremptory reasons; 2) the fundamental guarantee of electoral anteriority as a trump against the majority; 3) interpretation and legal reasoning based on fundamental rights; 4) the role of the judicial review on the protection of fundamental rights.
