Os tribunais eleitorais e as candidaturas femininas fictícias

Abstract

Examina a desigualdade de gênero nas casas legislativas, enfatizando o papel dos tribunais eleitorais em casos de supostas candidaturas femininas fictícias. Tais candidaturas são um dos principais obstáculos à efetivação das cotas eleitorais de gênero e à ampliação do número de parlamentares eleitas. Como os tribunais eleitorais vêm lidando com essa fraude à legislação? A partir da análise de três decisões emblemáticas, foi possível verificar que o TSE e o TRE-SP passaram a dar mais atenção a esse fenômeno, ampliando a possibilidade de impugnação do descumprimento dos percentuais de candidaturas de cada gênero e determinando, quando cabível, sanções capazes de coibir esta prática.

It analyzes the gender inequality in parliaments, focusing on the role of electoral courts in cases involving supposed fictitious female candidates. Such candidacies are one of the main obstacles to the effectiveness of electoral gender quotas and to the increase in the number of women elected. How are the electoral courts dealing with this kind of fraud? Based on the analysis of three emblematic judicial rulings, I conclude that Superior Electoral Court and the Electoral Court of São Paulo began to pay more attention to this phenomenon, through the expansion of the possibility of contesting the noncompliance with gender quota law and through the application of sanctions capable of curbing this practice.
