Ativismo judicial eleitoral

Abstract

O objetivo deste artigo é compreender as características do ativismo judicial em âmbito eleitoral. Busca-se, a partir da diferenciação entre ativismo judicial eleitoral e judicialização da política, contornar o ativismo judicial, embora haja alguma identidade entre esses fenômenos. Analisa-se os argumentos contrários e favoráveis ao ativismo judicial. Conclui-se que a complementação da lei, por meio das resoluções do Tribunal Superior Eleitoral, é uma forma de ativismo judicial eleitoral.

The purpose of this article is to understand the characteristics of judicial activism in the electoral sphere. From the differentiation between the electoral judiciary asset and the judicialization of politics, we seek to circumvent or activate the judiciary, although there is some identity between these cases. Consider the arguments against and in favor of judicial activism. It concluded that the complementation of the law, through the measures of the Superior Electoral Court, is a form of electoral judicial activism.
