Sistema político municipal : um estudo sobre as eleições legislativas em Divinópolis a partir de Niklas Luhmann

Abstract

Busca mostrar a falta de representatividade dos partidos políticos e a crise da democracia representativa no Brasil. Para isso, recorre à Teoria da Constituição - a relação de tensão entre democracia e constitucionalismo como elemento fundamental para um Estado Democrático de Direito - e à Teoria dos Sistemas de Niklas Luhmann - sobre o código próprio da política entre situação e oposição e essa relação com maioria e minoria. As constatações acerca das crises e as teorias apresentadas são aplicadas às eleições da Câmara dos Vereadores do Município de Divinópolis-MG, entre 1996-2012, para mostrar que o pluripartidarismo ali existente não tem significado a pluralidade de ideias, mas uso das legendas sem compromisso com agendas políticas, o que pôde ser visto pelos dados sobre trocas de partidos entre os candidatos/ eleitos e as variações a respeito de reeleições. Constata-se que as eleições não têm sido o reflexo daquilo que Luhmann descreve como processo de chancelamento ou recusa à validade de políticas partidárias.It aims at highlighting the absence of representativeness and legitimacy of political parties and the crisis of representative democracy in Brazil. Thus it falls upon the Constitutional Theory - to show the tense relationship between democracy and constitutionalism as a fundamental element for the Democratic Rule of Law - and the Systems Theory by Niklas Luhmann - on the political binary code between situation and opposition and the relationship with majority and minority. The findings about those crises and theories were applied to the Divinópolis - MG Chamber of Aldermen city elections between 1996-2012, to show that the multiparty system that exists in that city has not meant the existence of plurality of ideas, but instead an use of political parties without any engagement with political agendas or programs, which can be seen by the data on political parties exchanges by candidates/elected and variations about reelections. It is observed that elections have not been the reflection of what Luhmann describes as the endorsement or refuse of the validity of party politics.
