O impacto da EC 115/2022 na Justiça Eleitoral

Abstract

Investiga o impacto da inclusão da proteção de dados pessoais como um direito fundamental, conforme estabelecido pela Emenda Constitucional 115, no contexto da justiça eleitoral brasileira. Explora-se a importância dessa inclusão no artigo 5º da Constituição Federal e seu possível impacto no funcionamento do sistema eleitoral. Inicialmente, a pesquisa aborda o conceito de cibercidadania e a relação com a Lei Geral de Proteção de Dados (LGPD), seguida de uma análise sobre como essa legislação se relaciona com a justiça eleitoral. Em seguida, examina-se a emenda mencionada e seu posicionamento em relação aos direitos fundamentais, além de seus efeitos na justiça eleitoral. O método dedutivo é utilizado para conduzir a pesquisa, que se baseia em princípios gerais para chegar a conclusões. O marco teórico inclui a perspectiva de Manuel Castells sobre a sociedade da informação, que destaca o papel central das tecnologias da informação e comunicação na sociedade contemporânea. A LGPD, promulgada em 2018, visa proteger dados pessoais em meios digitais e é relevante para a justiça eleitoral, que utiliza esses dados para várias finalidades, incluindo o cadastro de eleitores e a organização de eleições. A pesquisa busca compreender como a proteção de dados como direito fundamental pode afetar o uso desses dados pela justiça eleitoral.

It investigates the impact of including the protection of personal data as a fundamental right, as established by Constitutional Amendment 115, in the context of the Brazilian electoral justice system. It explores the importance of this inclusion in Article 5 of the Federal Constitution and its potential impact on the functioning of the electoral system. Initially, the research addresses the concept of cybercitizenship and its relationship with the General Data Protection Law (LGPD), followed by an analysis of how this legislation relates to electoral justice. Next, the mentioned amendment and its position regarding fundamental rights are examined, along with its effects on electoral justice. The deductive method is used to conduct the research, based on general principles to reach conclusions. The theoretical framework includes Manuel Castells' perspective on the information society, highlighting the central role of information and communication technologies in contemporary society. The LGPD, enacted in 2018, aims to protect personal data in digital media and is relevant to electoral justice, which uses this data for various purposes, including voter registration and organizing elections. The research seeks to understand how the protection of data as a fundamental right can affect the use of such data by electoral justice.
