Propaganda eleitoral antecipada : teoria funcionalista sistêmica versus teoria clássica da propaganda eleitoral

Abstract

Traz à discussão a atual e problemática interpretação do conceito de propaganda eleitoral pós Lei nº 13.488/2017, em especial no que diz respeito à propaganda eleitoral impulsionada pela internet, bem como quanto aos eventos de verdadeira pré-campanha que vêm ocorrendo por todo o Brasil visando às futuras candidaturas presidenciais. Como sugestão de interpretação dos novos dispositivos, este texto apresenta como tese uma nova forma de se interpretar o arcabouço positivado sobre a matéria, sugerindo o uso da Teoria Funcionalista Sistêmica da Propaganda Eleitoral, em contraposição à Teoria Clássica da Propaganda.

It brings to discussion the current and problematic interpretation of the concept of electoral propaganda after Law N. 13.488/2017, especially with regard to internet-driven electoral propaganda, as well as the true pre-campaign events that have been taking place by all over Brazil with a view to future presidential nominations. As a suggestion of interpretation of the new devices, this text presents as thesis a new way of interpreting the assured framework on the subject, suggesting the use of the Systemic Functional Theory of Electoral Propaganda, as opposed to the Classical Theory of Propaganda.
