A compra de votos e seus impactos na democracia brasileira : uma análise à luz do artigo 41-A da Lei nº 9.504/97

Abstract

Analisa a prática da compra de votos, sob a ótica do Art. 41-A da Lei nº 9.504/97, destacando seu impacto nocivo na democracia brasileira. Essa conduta ilícita compromete diretamente a liberdade e autonomia do voto popular, distorce a representatividade política e aprofunda as desigualdades sociais, minando o exercício pleno da cidadania. O objetivo central deste estudo foi examinar o impacto da captação ilícita de sufrágio na integridade do processo eleitoral e na efetiva representatividade democrática, analisando suas implicações para o sistema político e buscando soluções concretas para garantir eleições mais justas e transparentes. A metodologia adotada foi mista, combinando abordagens quantitativa e qualitativa, e a investigação realizou-se por meio de questionários estruturados aplicados a eleitores no município de Buritis- MG. Os resultados obtidos revelaram a persistência alarmante da compra de votos, mesmo diante da legislação vigente e das ações da Justiça Eleitoral, sugerindo um claro descrédito da população em relação à eficácia das sanções aplicadas. A pesquisa aponta, assim, para a urgência de ações educativas robustas, o fortalecimento contínuo das instituições democráticas e o aprimoramento da legislação existente como medidas essenciais e indispensáveis para combater essa prática prejudicial e assegurar a integridade do processo democrático no país.It analyzes the practice of vote buying, from the perspective of Article 41-A of Law No. 9.504/97, highlighting its harmful impact on Brazilian democracy. This illicit conduct directly compromises the freedom and autonomy of popular vote, distorts political representation, and deepens social inequalities, undermining the full exercise of citizenship. The central objective of this study was to examine the impact of illicit suffrage capture on the integrity of the electoral process and on effective democratic representation, analyzing its implications for the political system and seeking concrete solutions to ensure fairer and more transparent elections. The adopted methodology was mixed, combining quantitative and qualitative approaches, and the investigation was carried out through structured questionnaires applied to voters in the municipality of Buritis-MG. The results obtained revealed the alarming persistence of vote buying, even in the face of current legislation and the actions of the Electoral Justice, suggesting a clear discredit of the population regarding the effectiveness of the sanctions applied. The research thus points to the urgency of robust educational actions, the continuous strengthening of democratic institutions, and the improvement of existing legislation as essential and indispensable measures to combat this harmful practice and ensure the integrity of the democratic process in the country.
