A liberdade e limitação de fusão e incorporação de partidos políticos no Brasil

Abstract

Analisa normas constitucionais e legais sobre a fusão e incorporação de partidos políticos no Brasil, bem como as Ações Direta de Inconstitucionalidade - ADI nº 5.311 e nº 6.044, peticionadas, respectivamente, pelo Partido Republicano da Ordem Social - PROS e pela Rede Sustentabilidade, questionando a constitucionalidade de dispositivos da Lei nº 13.107 de 2015, que altera a Lei nº 9.096 de 1995, para dispor sobre a fusão ou incorporação de partidos políticos. A partir de uma pesquisa realizada na página do Supremo Tribunal Federal - STF, buscou-se analisar se a fusão ou incorporação de partidos políticos no sistema jurídico brasileiro é livre ou limitada. Os resultados obtidos neste artigo apontam que no julgamento da ADI 5311, o STF decidiu que é livre a fusão e incorporação de partidos políticos, mas condicionadas aos princípios do sistema democrático representativo e do pluripartidarismo, previstos na Constituição da República.

It analyzes constitutional and legal norms on the merger and incorporation of political parties in Brazil, as well as the Direct Unconstitutionality Actions - ADI nº 5.311 and nº 6.044, petitioned, respectively, by the Social Order Republican Party - PROS and by the Sustainability Network, questioning the constitutionality of provisions of Law No. 13.107 of 2015, which amends Law No. 9,096 of 1995, to provide for the merger or incorporation of political parties. Based on a survey carried out on the website of the Supreme Court - STF, we sought to analyze whether the merger or incorporation of political parties into the Brazilian legal system is free or limited. The results obtained in this article indicate that in the judgment of ADI 5311, the STF decided that the merger and incorporation of political parties is free, but subject to the principles of the representative democratic system and multi-party system, as provided for in the Constitution of the Republic.
