Eleição presidencial de 2018 : algumas considerações sobre os aspectos jurídico-institucionais da decisão proferida pelo Tribunal Superior Eleitoral no requerimento de registro de candidatura de Luiz Inácio Lula da Silva

Abstract

Analisa, sob dois aspectos, a decisão proferida pelo Tribunal Superior Eleitoral que indeferiu o registro de candidatura do ex-presidente Luiz Inácio Lula da Silva para disputar a eleição presidencial de 2018. Primeiro, a partir do compromisso do Tribunal diante da medida cautelar expedida por órgão da ONU e, segundo, sob a ótica da imediata execução do indeferimento por meio do afastamento da condição sub judice do registro. Para tanto, buscou-se a lição doutrinária a respeito da internalização dos tratados internacionais, cotejando o conteúdo apurado com a atual situação do Primeiro Protocolo Facultativo ao Pacto Internacional, que legitima a atuação do Comitê da ONU. Quanto aos efeitos instantâneos da decisão, que puseram termo aos atos de campanha e afastaram o requerente da disputa eleitoral, buscaram-se os contornos da condição sub judice por meio de uma análise sistêmica, considerando o material jurisprudencial e os princípios que norteiam o processo eleitoral. Com isto, notou-se o acerto da decisão judicial - representada pelos termos expostos no voto do ministro Relator Luís Roberto Barroso - no sentido de rejeitar a carga vinculativa da medida cautelar concedida pelo Comitê, bem como pela execução imediata do indeferimento, fundamentada pela segurança jurídica do processo eleitoral.

It analyzes the ruling issued by the Superior Electoral Court that rejected the candidacy of former President Luiz Inacio Lula da Silva for the 2018 presidential election in two respects: the Tribunal's commitment to the interim measure issued by a UN body, and the immediate execution of the refusal, removing the sub judice condition from the register. In order to do so, it soughts a doctrinal lesson regarding the internalization of the International Treaties, comparing the content established with the current situation of the First Optional Protocol to the International Pact, which legitimizes the work of the UN Committee. As for the instantaneous effects of the decision, which put an end to the campaign actions and alienated the applicant from the electoral contest, the contours of the sub judice condition were sought through a systemic analysis, considering the jurisprudential material and the principles that guide the electoral process. As a result, it was noted that the judicial decision - represented by the terms set out in the vote of the Minister Rapporteur Luís Roberto Barroso - was correct in rejecting the binding burden of the precautionary measure granted by the Committee, as well as the immediate execution of the refusal, based on security of the electoral process.
