Reforma eleitoral : perspectivas atuais

Abstract

Discute como decisões paradigmáticas do Supremo Tribunal Federal e do Tribunal Superior Eleitoral e reformas legislativas recentes repercutem no sistema eleitoral adotado pela Constituição de 1988. Objetiva analisar especificamente o estágio atual do sistema eleitoral brasileiro quanto às regras de eleição proporcional e quanto às regras vigentes de financiamento de partidos políticos e campanhas eleitorais, alertando que qualquer tipo de reforma política deve ser bem analisada e conduzida com cuidado. Conclui que é preciso evitar concepções aventureiras, comprometedoras do capital institucional acumulado com sacrifício, ressalvando que é válido incentivar inovações e experimentos institucionais que busquem responder às complexidades de uma sociedade submetida a empreitadas de risco.It discusses how paradigmatic decisions of the Federal Supreme Court and the Superior Electoral Court and recent legislative reforms have repercussions on the electoral system adopted by the Constitution of 1988. It aims to analyze specifically the current stage of the Brazilian electoral system regarding the rules of proportional election and the current rules of Financing of political parties and electoral campaigns, warning that any kind of political reform should be well analyzed and carefully conducted. It concludes that it is necessary to avoid adventurous conceptions, compromising of the accumulated institutional capital with sacrifice, noting that it is valid to encourage innovations and institutional experiments that seek to respond to the complexities of a society submitted to risky contracts.
