A perda do mandato parlamentar : um olhar a partir do conceito de fortuna e virtù em Maquiiavel

Abstract

Examina a perda do mandato parlamentar no sistema eleitoral brasileiro. Parte-se da discussão travada na ação penal 470 que tramitou perante Supremo Tribunal Federal e apreciou um esquema de compra de votos de parlamentares, com o objetivo de garantir a base aliada para os projetos do governo federal e, ao final, condenou vários deputados federais que foram impedidos do exercício do mandato parlamentar. A partir desse fato, a perda do mandato parlamentar é apreciada cotejando-se as ideias de Maquiavel sobre os ciclos do Estado, a movimentação da história pela fortuna e a intervenção dos homens de virtù. Conclui-se que o exercício do poder, na atualidade, não é conquistado por meio da força ou da habilidade política do homem, muito menos é um fim em si mesmo, pois decorre do mandato, cujo controle é realizado pelo partido político e só pode ser exercido por ser proveniente do poder que emana do povo devendo, assim, ser fundado na ética, na moralidade e no bem gerir a coisa pública.

It examines the loss of the parliamentary mandate in the brazilian electoral system. It starts with the discussion fought in the prosecution 470 and underway before the Supreme Court and enjoyed a buying scheme vote of parliamentarians, in order to ensure the allied base for the projects of the federal government and, ultimately, condemned several deputies, and they were prevented the exercise of parliamentary duties. From this fact, the loss of the parliamentary mandate is appreciated comparing to the Machiavelli's ideas about the state cycles, the movement of history by fortune and the intervention of the virtù men. We conclude that the exercise of power, at the present, is not conquered by force or political ability of the man, much less it is an end in itself, since it follows from the mandate, the control of which is held by the political party and can only be exercised by come from the power that emanates from the people and should therefore be founded on ethics, morality and well manage public affairs.
