Autor e reú : um estudo do acesso à justiça no Brasil Republicano (1890-1930)

Abstract

Reflete sobre a questão da cidadania no Brasil dos primeiros anos republicanos a partir da avaliação do acesso da população à justiça. O estudo envolve a análise de documentação do Poder Judiciário, principalmente de processos e ações impetradas pela população da cidade do Rio de Janeiro, no período de 1890 a 1930, buscando no poder público soluções para questões referentes ao cotidiano. A cidade do Rio de Janeiro apresentava características singulares, incluindo uma população heterogênea, movimentos sociais significativos e o fato de possuir a estrutura administrativa da Capital Federal. 1890 é o ano da publicação do Código Penal e de uma sucessão de leis tratando da organização do Poder Judiciário e 1930 um marco do início das principais alterações nesta mesma organização e nas relações entre a sociedade e o Estado.

Reflection on the subject of the citizenship in Brazil of the first republican years starting from the evaluation of the access of the population to the justice. The study involves the analysis of documentation of the Judiciary Power, mainly of processes and actions petitioned by the population of the city of Rio de Janeiro, in the period from 1890 to 1930, looking for in the power public solutions for subjects regarding the daily. The city of Rio de Janeiro presented singular characteristics, including a heterogeneous population, significant social movements and the fact of possessing the administrative structure of the Federal Capital. 1890 are the year of the publication of the Penal Code and of a succession of laws treating of the organization of the Judiciary Power and 1930 a mark of the beginning of the main alterations in this same organization and in the relationships between the society and the State.
