Evolução da legislação eleitoral produzida entre 1984 e 2015 : da redemocratização à reforma eleitoral

Abstract

Apresenta a evolução da legislação eleitoral brasileira, apresentando as modificações nas principais legislações, como a Constituição Federal de 1967, a Constituição Federal de 1988, o Código Eleitoral, a Lei das Eleições e a Lei dos Partidos Políticos. Tal exposição tem como objetivo analisar as modificações e apresentar propostas relevantes de reforma eleitoral buscando verificar quais itens foram alcançados e quais os pontos ainda estão distantes da realidade. É considerada a evolução do sistema eleitoral e de toda a legislação criada no período entre 1984 e 2015, verificando as propostas elaboradas durante esse período pelos cientistas políticos e quais foram os resultados alcançados. O trabalho apresenta o desenvolvimento das eleições, os avanços em busca da igualdade de gênero, do desenvolvimento de novas tecnologias para o sistema de votação, do combate à corrupção, da busca pela diminuição dos gastos de campanhas e da regulamentação das formas de publicidade durante o pleito. O resultado do trabalho demonstra grande evolução, mas sem atenção as reformas propostas pelos teóricos, seguindo as tendências temporais e não o planejamento em longo prazo.

It presents the evolution of brazilian electoral legislation, presenting changes in the main legislation, such as the Federal Constitution of 1967, the Federal Constitution of 1988, the Electoral Code, the Election Law and the Law of Political Parties. Such an exposition aims to analyze the changes and present relevant electoral reform proposals in order to verify which items were reached and which points are still far from the reality. It is considered the evolution of the electoral system and of all the legislation created in the period between 1984 and 2015, checking the proposals made during this period by the political scientists and what the results were achieved. The work presents the development of the elections, advances in the pursuit of gender equality, the development of new technologies for the voting system, the fight against corruption, the search for reduced campaign spending and the regulation of forms of advertising during the Litigation. The result of this work shows a great evolution, but without attention the reforms proposed by the theorists, following the temporal tendencies and not the long-term planning.
