A distribuição das sobras eleitorais nas eleições proporcionais : um exame do julgamento da ADI 5947/DF pelo Supremo Tribunal Federal

Abstract

Examina o julgamento da ADI 5947/DF pelo STF, que decidiu acerca da regra que possibilitou que todas as legendas participassem da distribuição das sobras eleitorais. O objetivo do presente estudo é analisar de que forma a decisão impactou na discussão sobre a distribuição das sobras eleitorais nas eleições proporcionais e, sobretudo, se esta resguardou a representação das minorias nas Casas Legislativas brasileiras. O método de abordagem escolhido para a conduzir a pesquisa apresentada neste artigo é o hipotético-dedutivo, cujas técnicas escolhidas foram a pesquisa bibliográfica e o uso de decisões judiciais. Verificou-se acertada a decisão, visto que priorizou a representação dos grupos minoritários, prezando pela a igualdade do voto e garantindo a possibilidade das legendas menores participarem de forma igualitária nas eleições frente aos grandes partidos. Conclui que o julgamento da ADI 5947/DF faz parte da judicialização da reforma política, em que o STF atuou em um posicionamento contramajoritário de proteção as minorias frente ás maiorias.

It examines the judgment of the ADI 5947 / DF by the STF, which decided on the rule that allowed all the subtitles to participate in the distribution of electoral surpluses. The aim of the present study is to analyze how the decision impacted the discussion on the distribution of electoral surpluses in proportional elections and, above all, whether this safeguarded the representation of minorities in the Brazilian Legislative Houses. The method of approach chosen to conduct the research presented in this article is hypothetical-deductive, whose techniques chosen were bibliographic research and the use of judicial decisions. The decision was correct, since it prioritized the representation of minority groups, valuing the equality of the vote and guaranteeing the possibility of the minorities to participate equally in the elections facing the big parties. It concludes that the judgment of ADI 5947/DF is part of the judicialization of political reform, in which the STF acted in a countermajoritarian position to protect minorities against the majorities.
