Processo constitucional e democracia : ensaio sobre a construção participada da decisão eleitoral no estado democrático de direito

Abstract

A noção de processo impõe-se seja revisitada, de forma a conformar-se com as teorias pós-modernas, especialmente do processo constitucional. Pretende o presente ensaio demonstrar que o processo no Estado democrático de direito é garantia constitutiva de direitos fundamentais, encontrando-se superada a noção de processo como relação jurídica entre as partes. O processo assim compreendido importa na construção da decisão judicial pelas partes afetadas pelo provimento, mediante a instauração de um discurso legítimo, evidenciando a superação da construção dessa decisão pelo juiz solipsista.The notion of process requires it to be revisited in order to comply with the postmodern theories, especially the constitutional process. This essay seeks to demonstrate that the process in a democratic state is a constitutive guarantee of fundamental rights, showing that the notion of process as legal relationship between the parties is resolved. The process thus understood matters in the construction of the judgment by the parties affected by the provision, through the establishment of a legitimate discourse, showing the construction of overcoming this decision by the solipsistic Judge.
