A judicialização da megapolítica e sua ameaça à democracia

Abstract

Aborda o fenômeno da judicialização da política nas últimas décadas, os fatores que propiciaram seu surgimento e sua evolução que chega a incidir sobre um nível mais elevado da política, denominado de megapolítica. Aborda a necessidade que este fenômeno possui de um regime democrático para poder prosperar e as simultâneas ameaças que ele produz à democracia, pois retirada do povo o poder de decisões importante para os rumos da nação e do Estado para delegar ao Judiciário, poder sem atuação política e competência para tanto.It deals with the phenomenon of the judicialization of politics in the last decades, the factors that allowed its emergence and its evolution that comes to focus on a higher level of politics, called megapolitics. It addresses the need that this phenomenon has of a democratic regime to be able to thrive and the simultaneous threats that it produces to democracy, since it removes from the people the power of decisions important for the direction of the nation and the State to delegate to the judiciary, power without political action and competence to do so.
