A modernidade líquida a justiça eleitoral

Abstract

Busca elencar as características básicas que definem a Modernidade Líquida, segundo Zygmunt Bauman, em contraste com a Modernidade Sólida. Em seguida, trata do anseio da própria sociedade por Eleições justas, seguras e legítimas, devido ao ambiente de constante mudança que é típico da atual fase da modernidade. A Justiça Eleitoral surge no esteio de trazer segurança e estabilidade às Eleições, mas esta situação em tempos de modernidade líquida gera um aumento da ambiguidade da própria Justiça Eleitoral. O desenvolvimento tecnológico e a sociedade em mudança criam situações que precisam ser resolvidas, e a resposta dada em uma Eleição não supre a resolução de um novo problema. Por fim, se analisa qual o futuro da própria Justiça Eleitoral em tempos de modernidade líquida. Buscar para a Justiça Eleitoral um caminho entre o desenvolvimento tecnológico e uma sociedade em constante desenvolvimento e a garantia de uma disputa eleitoral equânime e equilibrada entre os candidatos.

It seeks to list the basic characteristics that define Liquid Modernity, according to Zygmunt Bauman, in contrast to Solid Modernity. Then, the society's longing for fair, safe and legitimate elections, due to an environment of constant change, typical of this very phase of modernity. Electoral Justice arises in support of bringing security and stability to the Elections, but this situation in times of liquid modernity generates an increase in the ambiguity of the Electoral Justice itself. Technological development and the changing society create situations that need to be resolved and the answer given in an Election does not solve a new problem. Finally, this article analyses the future of Electoral Justice itself in times of liquid modernity. Search for a path for the Electoral Court between technological development and a society in constant development and the guarantee of an equitable and balanced electoral dispute between candidates.
