O uso abusivo do big data no contexto eleitoral e a (in)eficácia dos instrumentos de proteção jurídica da legislação brasileira

Abstract

O mundo vivencia hoje a ascensão desenfreada da tecnologia, estigmatizada pela Terceira Revolução Industrial. Em vista do oferecimento de oportunidades múltiplas para seus usuários, em troca da mitigação de seus direitos, observa-se o uso impetuoso e abusivo da big data no contexto eleitoral como forma de parcializar campanhas. Valendo-se de pesquisa bibliográfica, buscou-se examinar referida prática, contextualizando o uso do profiling em detrimento da perda do sentido cognitivo dos indivíduos em confronto com os princípios basilares que regem o processo eleitoral e o sistema democrático de Direito, bem como a fragilidade do sistema legislativo nacional para combater referidas práticas. Finaliza-se com a perspectiva do abuso de poder informacional para fins de gerar a cassação da chapa Bolsonaro-Mourão nas eleições presidenciais de 2018.The world is currently experiencing the unbridled rise of technology, stigmatized by the Third Industrial Revolution. Due to offering multiple opportunities to its users, in exchange for mitigating their rights, there is the impetuous and abusive use of big data in the electoral context as a way of partializing campaigns. Using bibliographical research, we sought to examine this practice, contextualizing the use of profiling to the detriment of the loss of cognitive meaning of individuals, in comparison with the basic principles that govern the electoral process and the democratic system of Law, as well as the fragility of the national legislative system to combat such practices. It ends with the perspective of the abuse of informational power with the purpose of causing the impeachment of the Bolsonaro-Mourão partisan ticket in the 2018 presidential elections.
