Liberdade de expressão, princípio da igualdade e pré-campanha eleitoral

Abstract

Trata de uma crítica ao sistema legislativo e jurisprudencial brasileiro atual em relação à propaganda política no período de pré-campanha eleitoral, frente à garantia constitucional fundamental da liberdade de expressão. A sociedade moderna mostra-se plural e diversificada e dessa forma ao Estado proporcionar meios para que todos os grupos possam participar efetivamente dele e se sintam pertencentes a ele. A Constituição Federal de 1988 traz, em seu bojo, meios e formas de abarcar essas diferenças, e um deles poderia ocorrer por meio da liberdade de expressão, com a possibilidade de manifestação da intenção de candidatar-se a qualquer tempo. A participação e a integração de todos os grupos que formam a sociedade brasileira plural tendem a possibilitar a diminuição da desigualdade na medida em que os próprios excluídos passam a ter a possibilidade de pensar e influenciar no destino do Estado.

It is a critique of the current Brazilian legislative and jurisprudential system in relation to political propaganda in the pre-election campaign period in view of the fundamental constitutional guarantee of freedom of expression. Modern society appears to be plural, diverse and, therefore, the State is responsible for providing means so that all groups can effectively participate in this State and feel that they belong to this State. The 1988 Federal Constitution brings within it means and forms to encompass these differences, and one of them could be through freedom of expression with the possibility of expressing an intention to run for office at any time. Participation, the integration of all corporate groups that form the plural Brazilian society, tends to make it possible to reduce inequality as the excluded themselves begin to have the possibility of thinking and influencing the destiny of the State.
