Mandatos coletivos : entre a experiência e o vácuo legislativo

Abstract

Apresenta a figura do mandato coletivo, através da análise de notícias veiculadas na mídia eletrônica e da imagem construída pelos grupos em propagandas eleitorais e páginas oficiais na internet. Em seguida, pontuam-se as funções do sistema de justiça eleitoral segundo a doutrina. Após, observa como o sistema de justiça eleitoral tem atuado diante da candidatura dos polimandatos, por meio da análise de impugnações e/ou dos processos de requerimento de candidatura. Ao final, são expostas algumas implicações jurídicas e políticas dos mandatos coletivos e a importância da atuação dentro do direito processual eleitoral diante da figura das candidaturas coletivas.It presents the figure of the shared mandates, through the analysis of news published in the electronic media and the image built by the groups in electoral advertisements and official pages on the Internet. Then, it presents the functions of the electoral justice system. So, it observes how the electoral justice system has acted before the shared mandates through the analysis of judicial challenges and/or the application of electoral. In the end, it exposes some legal and political implications of the collective mandates and returns to the importance of acting within the electoral procedural law in the face of shared mandates.
