De crime eleitoral à segurança nacional : fake news no Poder Legislativo brasileiro

Abstract

Analisa o conteúdo de 21 projetos de lei, que tramitaram no Congresso Nacional brasileiro durante os anos de 2017 e 2018, com o escopo de combate à produção e disseminação de fake news. A escolha desse corpus inspira-se no pensamento de Timothy Cook (2005) e Paul Starr (2004), cujos estudos sustentam que as políticas e as práticas políticas fornecem a base para o poder político e econômico da mídia atual, favorecendo formas particulares de comunicação e moldando os usos de novas tecnologias. Por meio da análise temática, buscou-se compreender como as propostas legislativas que abordam o fenômeno fake news têm construído questões sobre: (1) a legislação a que se referem; (2) como definem fake news; (3) o que constitui crime; e (4) de que forma essas propostas atravessam a imprensa. Chegou-se a reflexão de que, além das disputas políticas que envolvem a aprovação de projetos de lei, a fragilidade no entendimento do que se busca controlar pode criar novos desafios para a imprensa dentro do jogo de disputas institucionais.

It analyses the content of 21 bills that were processed in the brazilian National Congress from the years 2017 to 2018, whose scope includes the fight against the production and dissemination of fake news. The choice of this corpus is inspired by the thinking of Timothy Cook (2005) and Paul Starr (2004), whose studies hold that political policies and political practices provide the basis for the political and economic power of the contemporary media, favoring particular forms of communication and shaping the uses of new technologies. Through thematic analysis (Bardin, 1977), we sought to understand how this bills that address the phenomena fake news have built up questions about: (1) previous legislations; (2) how define fake news; (3) what a crime is; and (4) how these proposals cross the press. We realize that besides the political disputes that involve the approval of bills, the fragility in the understanding of what is sought to control can create new challenges for the press within the game of institutional disputes.
